Certain provisions of the Distance Contracts Regulation have been amended by the Official Gazette published on 24.05.2025. The effective date of the amendments is 01.01.2026. We present the detailed information regarding the amendments below for your attention.
SUMMARY: The provision that was planned to enter into force on 01.01.2026, which would have allowed sellers to charge consumers the return shipping costs of returned products in cases where the consumer exercises the right of withdrawal in sales conducted through e-commerce channels, provided that this was stipulated in the distance sales contract, has been repealed. In the period following 01.01.2026, the costs and charges of return shipments within the scope of the right of withdrawal shall continue to be borne by the seller.
Additionally, the provision that was added stipulating that mobile phones, smart watches, tablets, and computers delivered to the consumer could not be returned within the scope of the right of withdrawal as of 01.01.2026 has been repealed.
All amendments shall enter into force on 01.01.2026.
